As owners attempt to speed the creation of capital assets and reduce the communication and responsibility issues that often lead to litigation during the construction process, many are abandoning the three‐party design‐award‐construct arrangements in favor of a single‐point responsibility procurement method like design-build. Design-build creates challenges for design professionals to meet their registration law obligations to protect public health, safety, and welfare when they are subcontractors to a design-builder or when they—as firms or in joint ventures—serve as the design-build entity.
